Excerpt from the Agreement on the public offer for the provision of services of the family amusement park “GALAXY” from September 1, 2020

Read the text of the RULES OF VISITING THE PARK and, if you do not agree with any of the points, or do not understand any of the points, we suggest you to refuse the offered Services and use of equipment in the Park, until you clarify the information. which interests you, in the Park Staff or on the official website: www.galaxypark.com.ua. In case of acceptance of the Services offered by you in the family amusement park “GALAXY” it is considered that you fully and unconditionally agree with all conditions of the public offer, in full and unconditionally accept it (including agree to fulfill all obligations which are on you rely on it) and you understand all its provisions.

The text of the Agreement (or an extract from the Agreement – Rules for visiting the Park, hereinafter – the “Rules for visiting”) is always posted on the information stand and in the User’s Corner at the entrance to the Park, and on the official website of the Operator and must be provided to the User until the moment of its acceptance of the terms of the Agreement.

2.4. Acceptance of the Operator’s proposal is the implementation by the User, by filling in the registration form / receipt at the box office and the total or separate performance of any of the following actions:

2.4.1. purchase of an Electronic Card, which is a means of payment and gives the right to use the Services of the Park;
2.4.2. payment by the User of any Operator’s Service;
2.4.3. use of the Park Services by the User.
Any of the above actions performed by the User in this sub-clause shall indicate
that the User is acquainted with this Agreement and the Rules of visiting the Park and
agrees to the terms in full.

4. General conditions of providing Services

4.1.1. The right to visit the Park is granted to the User after purchasing an Electronic Card at the box office and paying for the Operator’s Services. This Electronic Card is issued on the day of visiting the Park and is a means of payment for all Services in the Park and can be
used in subsequent visits. The validity of the Electronic Card is unlimited.

4.1.2. Upon receipt of the Electronic Card at the box office at the entrance to the Park, the User is obliged to visually inspect the box office without leaving the box office and make sure that there is no damage. Complaints of the User regarding the detection of damage to the electronic card are not accepted and are not
are considered by the Operator after the User has left the box office.

4.1.3. The User is fully responsible for the integrity, damage and loss of the electronic card and is obliged to present it at the request of the Operator’s staff. If the card is lost or damaged, the remaining amount on it is not refundable, the card is not renewed, and a new one is purchased.

4.1.4. Upon receipt of the Electronic Card, each User undertakes to comply with the terms of this Public Offer Agreement, the Rules of Visiting, as well as to maintain cleanliness and order throughout the Park. In case of violation of the terms of this Agreement and the Rules of Visit, the User bears full material and personal responsibility in accordance with the terms of this Agreement and current legislation of Ukraine.

4.1.5. The User can top up the Electronic Card (ie pay for the Operator’s Services) at the Park’s ticket offices at any time during the visit to the Park or on the Operator’s official website. If the User has not spent all the funds placed on the Electronic Card as payment for the Services, the balance is not refunded, but remains on the Electronic Card and can be used by the User during subsequent visits to the Park.

4.1.5a. Refunds or reductions in the cost of Services occur only in the event of unforeseen technical malfunctions of the Park equipment and the impossibility of its use. Other reasons are not a reason for a refund, namely: The user has changed his mind,
scared, disliked, in a hurry, no more plans to visit the Park and other biased reasons.

4.1.5b. Refunds are made only in accordance with the current legislation of Ukraine, namely in the presence of a fiscal check confirming payment for the Operator’s Services and an identity document.

4.1.7. In case of violation by the User of the Rules of visiting and conditions of the Agreement and, as a consequence, unilateral termination of the agreement by the Operator, the amount of the Operator’s Services paid by the User is not refunded.

4.4. Rules of conduct for Users in the Park.

4.4.5. The Operator reserves the right to take preventive measures, including, but not limited to: prohibit from being in the Park Users who are in a state of alcohol, drugs or other intoxication, in a mentally unbalanced state, as well as visitors who do not respond on the remarks of the Operator’s staff and do not comply with the terms of this Agreement and the Rules of Visit, without explaining to the User the reasons to call the police and / or security service for such Users in order to bring the behavior of the latter to generally accepted norms or forced removal from the Park.

4.4.6. Users are not allowed to bring food and drinks to the Park, as well as to eat and drink in places not specifically designated for this purpose.

4.4.7. Users are prohibited from bringing firearms, gas, air and cold steel weapons, sharp objects, as well as explosive and flammable, toxic substances with a strong and pungent odor into the Park.

4.4.7a For the safety of visitors and to avoid damage to the property of the Park, Users are prohibited from traveling throughout the Park on gyroboards / scooters, scooters, rollers, bicycles and other vehicles / vehicles, as well as to move on
territory of the Park with carts from the supermarket.

4.4.8. Users are not allowed to enter the Park with animals, birds, reptiles and any other living creatures.
4.4.10. Users are not allowed to enter the technical and office premises in the Park. Users who enter such premises are fully responsible for malfunctions and accidents that occur in this area.

4.4.11. Smoking and alcohol consumption are prohibited throughout the Park, except for specially designated areas

4.5. Rules of conduct at the attractions of the Park.

4.5.1. The use of amusement equipment and other equipment of the Park is allowed to persons who meet the safety standards for each attraction or equipment separately. The norms, prohibitions and restrictions for the Users are specified in this Agreement and on the information stands
near each attraction separately in the form of “Instructions for use of the attraction”. The Operator is not responsible for injuries to the User in case of violation of general safety regulations, recommendations of the Operator’s staff and Instructions for use of each attraction or equipment separately.

4.5.2. In order to ensure the personal safety of Users and preserve the integrity of the property of the Park, the Operator has the right to prohibit the use of attractions and equipment in dangerous clothing (clothing that may get into parts of the equipment of the Park and amusement park).

4.5.3. At the slightest signs of illness or injury, the User has the right to contact the medical center of the Park.

4.6. Visiting the Park by minors.

4.6.1. When visiting the Park of the group, which includes minors, the responsibility for compliance with the terms of this Agreement, the Rules of visiting the Park and the rules of safety is the head of the group. If the members of the group are adults, the responsibility for compliance with the terms of this Agreement, the Rules of visiting the Park and the rules of safety is borne by each such member of the group personally. The leader of the organized group is obliged to fill in a special registration form at the entrance to the Park – Receipt (app № 2).

4.6.2. In the Park, adults are obliged to supervise and accompany children, explain to children general safety rules and rules of conduct, rules for using attractions in accordance with the Instructions for use of the attraction, etc. and monitor children’s compliance with such rules, as adults are fully responsible for children .

4.6.3. With one adult, the Park has the right to visit no more than 3 (three) children aged 1 (one) to 5 (five) years, or no more than 5 (five) children aged 5 (five) to 10 ( ten) years, or not more than 7 (seven) children aged from 10 (ten) to 14 (fourteen) years.

4.6.4. Children under the age of 14 (fourteen) are required to visit the Park only when accompanied by an adult.

4.6.5. The responsibility for the safety of minors lies with their parents or the accompanying adults. Adults are not allowed to leave minor children unattended in the Park.

4.6.6. The responsibility for injuring a child in case of non-compliance with general safety regulations, deliberate disregard of the recommendations of the Operator’s personnel and the Instructions for the use of each attraction or equipment separately, is borne by the adult accompanying the child. The operator and his staff are not responsible in this case.

5. Rights and obligations of the Operator

5.2. Operator Rights

5.2.1. The Operator has the right not to allow the use of the Services, or to terminate the provision of Services in respect of persons intoxicated with alcohol, drugs and in other cases, without explaining the reasons for refusal to provide the Services, if in the opinion of understand and manage their actions and strictly adhere to the terms of this Agreement, the relevant “Instructions for the use of the attraction” and the Rules of visiting the park, without explaining to the User the reasons.

5.2.2. In case of gross or repeated violation of the terms of this Agreement, the User’s failure to respond to the comments of the Operator’s employees if the User’s actions are aimed at endangering the health, property, honor or dignity of other Users,
or for employees of the Operator, the Operator has the right to terminate the provision of the Service or set of Services to such User, block its illegal actions, and offer to leave the territory of the Park. In case the User commits actions that are subject to administrative signs
offense, or criminal offense, employees of the Operator in this case have the right to act in accordance with the requirements of current legislation of Ukraine regarding this User and to call law enforcement officials.

5.2.3. To unilaterally make changes to this Agreement with their prior publication on the official website of the Operator.

5.2.4. In case the User is unable to make a final payment for the Services provided or for losses incurred by the Operator, the Operator has the right to require the User to issue a promissory note valid to confirm the debt and ensure the fulfillment of the obligation in writing, in accordance to the requirements of Art. 547 – 548 of the Civil Code of Ukraine.

5.2.5. The operator reserves the right to organize the launch of attractions, schedules and modes of their operation.

6. Rights and obligations of the User

6.1. The user is obliged to:

6.1.1. Before paying for the Service or complex of Services, read the Rules of visiting the park and the terms of the Public Offer Agreement, of course, comply with the terms of this Agreement throughout the period of use of the Services.

6.1.3. Before using a particular type of amusement Park, other specific Service, or other equipment, carefully read the relevant “Instructions for use of the attraction”, which is located at the entrance to each attraction, or listen
briefing.

6.1.4. In case of any questions regarding safety when using attractions or other equipment, ask them before using the attraction (equipment) to the Operator’s employee and get comprehensive and meaningful answers. And only after that start using the appropriate attraction or equipment.

6.1.5. When using attractions or other equipment of the Park, comply with the legal requirements of the Operator’s employees and comply with the terms of this Agreement and the Rules for visiting the Park.

6.2.2. At the slightest signs of illness or injury, the User has the right to contact the medical center of the Park.

7. Liability for breach of contract

7.2. The Personnel of the Operator is authorized to apply measures in accordance with the terms of this Agreement and the current legislation of Ukraine in case the User commits an administrative offense, a criminal offense.

7.9. The Operator shall not be liable for damage caused by the Users as a result of an accident, injury or anything else caused by negligence on the part of the User / Users and / or third parties, and / or as a result of non-fulfillment or improper fulfillment of the terms of this Agreement. Park, relevant “Instructions for use of the attraction” and recommendations of the Operator’s staff.

8.3. The contract may be terminated:

8.3.1. By the User unilaterally by refusing the Service or a set of Services.

8.3.2. By the Operator unilaterally without return of the funds paid and not used by the User, in case of significant violation of the terms of this Agreement by the User.

8.3.3. The Operator unilaterally with the return of funds paid and not used by the User, provided that the Operator considers this User undesirable to visit the Park without explaining the reasons to the User.

8.3.4. On other grounds provided by the terms of this Agreement and current legislation of Ukraine.
